I have a 30 year mortgage and, like many, have fallen onto hard times. I can move into another house which I own that has NO mortgage payments. I do NOT want to hurt my credit by defaulting on my mortgage payments. How would I get someone to take over my mortgage payments (sell that house) so that they can own the house and not me?

I work for a contracting company and recently we changed the roof on a house that was damaged by a storm. The insurance company sent a check to pay for the work done on the roof. The check was drawn out to the owner of the house and the mortgage company, the owner told the mortgage company to keep the money from the insurance settlement to pay for his past mortgage payments and now the owner has not paid us (the contractor) and the mortgage company refuses to hand over the proceeds to us (the contractor), when the roof has been completely repaired. We applied and were approved for a refinance on our mortgage. The day before closing the underwriter says that the expenses we claimed in our tax return last year(approx $20k) were to be deducted from the income and therefore the ratio was off. I’ve never heard of this. I assumed that this
would have been looked at before approving the loan. Does this make sense? So I faxed the broker the last paycheck stub for 2006 that showed the total expenses reimbursed for the year were $9300. Shouldn’t that be considered and offset the expenses paid out. Does anyone know what to do in this case?
